DEFINITIONS

Parties: in the plural, refers collectively to Hotels at Home SAS and the User. In the singular, refers to either of the two Parties.

Services: refer to the services offered by Hotels at Home SAS on its website.

Site: refers to the website of Hotels at Home SAS accessible at the address ibisstore.com

User: refers to any internet user who accesses or browses the Site, whether a customer or a simple internet user with or without an account. A connected User is a User who has created an account on the Site.

PURPOSE

Hotels At Home SAS publishes the Site through which it provides Users with information and sells products (hereinafter the "Services") under the following conditions. Access to the Site implies the unconditional acceptance by the Client of these general conditions. These general conditions come into effect on the date of their publication and will be enforceable on the date of the first use of the Site. They are enforceable for the entire duration of the use of the Site and until new general conditions of use replace the present ones.

The User may at any time decide not to use the Site but remains responsible for any prior use.

Hotels At Home SAS reserves the right to enforce all legal means provided for by law and equity for any violation of these general conditions. All rights not expressly granted herein are reserved.

CONTENT

Hotels At Home cannot be held responsible for:

- the quality of the Site, as the Site is provided "as is".

- breaches of computer security that may damage Users' computer equipment and data;

- infringement of Users' rights in general

Hotels At Home makes its best efforts to provide up-to-date information on the Site.

All information made available to persons accessing the Site has been selected on a specific date. The information on the Site reflects an opinion at the time of its creation and not at the time of consultation of the Site. It may require an update that may not have occurred at the time of consultation for technical or other reasons.

Hotels At Home cannot be held responsible for direct or indirect damages that may result from downloading, accessing, or using the Site and the Application or the information contained therein, regardless of their nature.

Hotels At Home cannot be held responsible for any errors or omissions in the information provided on the Site. Any update, new Services, or new feature that improves or enhances one or more existing information contents will be subject to these conditions.

Hotels At Home disclaims any responsibility regarding the appropriateness of decisions made by Users solely based on the information published on the Site.

ACCESS TO THE SITE

Hotels At Home strives to provide quality access and allow Users to use the communication means made available to them under the best possible conditions.

Due to the nature and complexity of the internet network, and in particular, its technical performance and response times for consulting, querying, or transferring information data, Hotels At Home makes its best efforts to allow access and use of the Site and cannot guarantee absolute accessibility or availability of the Site.

However, Hotels At Home reserves the right, without notice or compensation, to temporarily or permanently close the Site, or access to one or more remote services, in particular to perform an update, maintenance operations, modifications, or changes to operational methods, servers, and accessibility hours, without limitation.

It is the User's responsibility to ensure the evolution possibilities of the computer and transmission means at their disposal so that these means can adapt to the Site's developments.

ACCOUNT CREATION

The User agrees not to create an account under the identity of a third party. They are solely responsible for the confidentiality of their credentials (username and password) allowing them to use their account.

Any use of their account through their personal username and password is presumed to have been made by the User or a third party authorized by the User, until their account is deactivated.

USER OBLIGATIONS

The User undertakes to use the Site as well as all information they may access only for purposes consistent with public order, morality, and the rights of third parties.

The User undertakes to provide accurate and up-to-date information, especially when creating their account.

In the event of non-compliance with the general terms of use of the Site, Hotels At Home reserves the right to deactivate, automatically and without compensation, the User's account after sending an email that remains unanswered for 30 days.

In the event of a manifest and significant breach and/or fraud by the User, the deactivation of the account will occur automatically, without notice, formality, or compensation.

The User also undertakes not to disrupt the use that other Users may make of the Site and not to access parts of the Site to which access is restricted.

COPYRIGHT

The general structure of the Site, its layout, and its content including, but not limited to, texts, slogans, diagrams, animated or non-animated images, photographs, software, and logos used as well as any other element composing the Site are the exclusive property of Hotels At Home or third parties who have granted it a license and are protected by copyright.

Any reproduction, representation, modification, or use by any process whatsoever and on any medium whatsoever of all or part of the Site and all or part of the various works that compose it, without the express authorization of Hotels At Home or the owner of the trademark concerned is prohibited without the consent of the owner of the trademark concerned. Any violation will be prosecuted as counterfeiting.

These general terms and conditions do not entail any assignment of any kind of intellectual property rights to the elements belonging to Hotels At Home or to the elements of third parties who have granted it a license, for the benefit of the User.

The User therefore undertakes not to take any action or act likely to directly or indirectly infringe the intellectual property rights of Hotels At Home and in particular to modify, copy, reproduce, download, distribute, transmit, commercially exploit and/or distribute in any way the pages of the Site, or the computer codes of the elements composing the Site.

ADVERTISING OR PROMOTION ON THE SITE

Hotels At Home reserves the right to broadcast, free of charge or for a fee, advertising or promotional messages on its Site.

HYPERTEXT LINKS

Hotels At Home reserves the right to set up hypertext links on the Site giving access to web pages other than those of its Site over which Hotels At Home has no control. Hotels at Home SAS disclaims all responsibility for the conditions of access to third-party sites via hypertext links, their operation, the use of Users' personal data, and the content of the information provided on these third-party sites.

The User who has a personal website and wishes to place, for personal purposes, on their website a simple link directly to the homepage of the Site, must obtain express authorization from Hotels At Home to establish this link.

APPLICABLE LAW AND JURISDICTION

These general terms and conditions of use of the Site are governed by French law.

This applies to substantive and procedural rules, notwithstanding the places of performance of the substantial or ancillary obligations.

In the event of a dispute between the Publisher and a User concerning the interpretation, execution, or termination of these, the Parties shall endeavor to settle it amicably.
